1. Services
PawPassRx provides documentation services for assistance animals, including service animal registration, identification cards, emotional support animal (ESA) letters, and psychiatric service dog (PSD) letters. PawPassRx is not a law firm and does not provide legal advice. Nothing on this site or in any document issued by PawPass constitutes legal advice.
Use of PawPassRx services is subject to these Terms of Service. By purchasing or using any PawPassRx product, you agree to be bound by these terms.
2. Letter services
ESA and PSD letter issuance requires completion of a health questionnaire and review by a licensed mental health professional (LMHP). The following apply:
- Letter approval is not guaranteed. The licensed professional conducting your review makes an independent clinical determination. PawPassRx does not override or influence that determination.
- If a letter is not issued because the professional determines you do not qualify, you are eligible for a full refund. See our Refund Policy for details.
- PawPassRx does not guarantee that any specific landlord, airline, employer, or business will accept your documentation. Acceptance of documentation is ultimately at the discretion of the party receiving it.
- Letters are valid for one year from the date of issuance. Annual renewal is recommended to keep documentation current.
3. Registration products
PawPassRx registration and identification products are optional identification tools. They provide documentation of your animal's registration in the PawPass system and enable verification via the PawPassRx verification portal.
Registration with PawPassRx does not create any legal rights. Federal law does not require service animals to be registered with any organization. Businesses and landlords are not legally required to accept registration as proof of an animal's status.
4. Refund policy
PawPassRx offers a 100% money-back guarantee on all products. If your letter is not issued or you are unsatisfied within 30 days of purchase, you may request a refund. Full terms are described in our Refund Policy.
5. Accuracy of information
PawPassRx makes reasonable efforts to keep the rights and legal information published on this site current and accurate. However:
- Users should verify legal information with primary sources, including ADA.gov, HUD.gov, and DOT.gov.
- Information on this site is not legal advice and does not create an attorney-client relationship.
- Laws and regulations change. PawPassRx updates content when changes occur but cannot guarantee that all content is current at all times.
6. User content & image license
You retain all ownership rights in any photos, descriptions, or other content you upload to PawPassRx ("User Content"). PawPassRx does not claim ownership of your animal's likeness or your photographs.
Your standard license to PawPassRx. By uploading User Content, you grant PawPassRx a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, copy, display, and use that User Content solely as needed to provide the services you ordered — for example, rendering your photo on your ID card and certificate, displaying it in your account portal, and including it in documents reviewed by your assigned clinician. This license terminates when you delete the content or close your account, except for residual copies in backups and audit logs we retain for the periods described in our Privacy Policy.
Optional marketing license (opt-in only). Separately and only when you affirmatively check the consent box presented at upload time, you also grant PawPassRx a non-exclusive, royalty-free license to use that specific photo on PawPassRx social media accounts, the PawPassRx website, email newsletters, and other marketing materials, with or without attribution. The marketing license applies only to photos for which you have explicitly opted in. Photos uploaded without consent are never used in marketing.
Revoking marketing consent. You can revoke marketing consent at any time by emailing [email protected]. On revocation, PawPassRx will remove the photo from active marketing channels we control within a reasonable time. Already-published material on third-party platforms (e.g. content saved or re-shared by other users, internet archives) is outside our control.
Your warranties.By uploading User Content, you represent that you own or control the necessary rights to upload it and to grant the licenses above; that the User Content does not infringe any third party's rights; and that any people identifiable in the photo (other than yourself) have given you their consent to share it.
7. Prohibited use
By using PawPassRx you agree that you will not:
- Misrepresent a pet as a service animal, emotional support animal, or psychiatric service dog when the animal does not qualify under applicable law. Fraudulently misrepresenting a pet as a service animal is illegal in most U.S. states and constitutes a material violation of these Terms.
- Use PawPassRx documentation for any unlawful purpose.
- Provide false information in any registration form or health questionnaire.
- Resell, transfer, or fraudulently duplicate any PawPassRx certificate, ID card, or letter.
PawPassRx reserves the right to revoke documentation and terminate accounts where prohibited use is determined to have occurred.
8. Governing law & venue
These Terms of Service are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict-of-laws principles. Subject to Section 9 (Arbitration) below, the exclusive venue for any judicial proceeding permitted under these Terms shall be the state and federal courts located in Davidson County, Tennessee, and you consent to the personal jurisdiction of those courts.
9. Arbitration & class-action waiver
Please read this section carefully — it affects your legal rights.
You and PawPassRx agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of PawPassRx services (a “Dispute”) shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and not in court. The arbitration shall be conducted in Davidson County, Tennessee, or remotely by mutual agreement. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.
Class-action waiver. You and PawPassRx each agree to bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims of multiple parties and may not preside over any form of representative or class proceeding.
Exceptions.Notwithstanding the foregoing, either party may (i) bring an individual action in small-claims court for any Dispute within that court's jurisdiction, and (ii) seek injunctive or other equitable relief in court to protect intellectual property rights or prevent unauthorized use of the service.
30-day opt-out. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these Terms with the subject “Arbitration Opt-Out” and your full name and account email. Opting out does not affect any other portion of these Terms.
