Delaware's Fair Housing Act mirrors federal FHA, the state's compact size makes complaint resolution unusually fast, and the Wilmington corporate-corridor and University of Delaware rental markets drive the most ESA pushback.

Delaware only extends access to fully-trained service dogs
The Americans with Disabilities Act applies in every Delaware city and county. Under the ADA, a service dog is a dog individually trained to perform tasks for a handler with a disability. Delaware businesses, restaurants, hotels, and public accommodations must permit service dogs — full stop. Staff may ask only the two ADA questions:

Delaware 16 Del. C. §9528 grants service dog handlers public-access rights consistent with the federal ADA across all Delaware public accommodations. Wilmington venues (Chase Center on the Riverfront), Dover International Speedway, and the Delaware beaches all maintain service-animal policies that comply with federal law.
Delaware 11 Del. C. §1325 (Cruelty to Animals — service-animal aggravators) ↗
Service animals are protected under Delaware's general animal cruelty statute with specific aggravators for harm to working service dogs.
Penalty: Misdemeanor for interference; felony for serious harm.
The day-to-day friction, not the legal question
You already know your service dog has full public-access rights under the ADA. The problem isn't the law — it's the Wilmington restaurant host, the Dover Uber driver, or the Newarkhotel front desk who don't know it. Every challenge takes time and emotional bandwidth you didn't plan to spend.
A printed ID card and a QR-verifiable registration shut that conversation down in seconds. They're not legally required — and we'll never tell you they are — but they're what most challengers actually want to see before they let you through.

About Our Products
