Do state laws override federal laws like the ADA or Fair Housing Act?
No — state laws cannot reduce your federal rights. The ADA, FHA, and ACAA set a floor that applies in all 50 states. State laws can add stronger protections (such as criminal penalties for misrepresenting a pet as a service animal, or expanded public access rights), but they cannot take federal protections away.
Which states have the strongest protections for emotional support animals?
Federal law (the FHA) governs ESA housing rights uniformly across all states. Some states — including California, New York, and Massachusetts — have additional consumer protections around how ESA letters are issued, including waiting periods between the first contact with a clinician and letter issuance. California's AB 468 is the most well-known state ESA law and PawPassRx letters are fully compliant with it.
Are some states stricter about service dog registration claims?
Yes. Many states, including California, Florida, Texas, and Virginia, have laws making it a misdemeanor to misrepresent a pet as a service animal. These laws don't penalize legitimate handlers — they target fraud. Our positioning has always been that registration is supplementary, not a legal substitute for an actual service dog under the ADA. State penalties are one more reason that misrepresenting a pet's status is a bad idea.
Do I need a different ESA letter for each state I move to?
Not under federal law — a valid ESA letter from a licensed mental health professional is recognized under the FHA in all states. However, the clinician who writes the letter must be licensed in your current state of residence. If you move to a new state, your next renewal should be from a clinician licensed there.
