What the law requires of you

HUD's 2020 guidance (FHEO-2020-01) and the Fair Housing Act lay out clear rules for how housing providers must handle assistance animal requests.

No blanket "no pets" policy

The FHA requires reasonable accommodation for assistance animals, regardless of your pet policy. Breed, size, and species restrictions generally do not apply to assistance animals.

Common questions

Can I require a tenant to use PawPassRx specifically?

No — the FHA does not allow housing providers to require tenants to use a specific documentation service. However, you can recommend PawPassRx and explain that it provides instantly verifiable letters, which simplifies your review process.

What if a tenant's letter is expired?

An expired letter does not satisfy the documentation requirement. You may ask the tenant to obtain a current letter. Our QR verification page clearly shows whether a letter is active or expired.

Can I charge a pet deposit or pet rent for an assistance animal?

No. Under the FHA, you cannot charge pet deposits, pet fees, or pet rent for assistance animals. However, you may charge for actual damage caused by the animal, just as you would for any tenant.

What if I'm unsure whether an accommodation request is valid?

If the disability and disability-related need are not obvious, you may request reliable documentation — a letter from a licensed mental health professional. If you have further questions, consider consulting a fair housing attorney before denying a request.
